Infiintare firma – Acordul vecinilor

La infiintarea unei societati comerciale (s.r.l., s.a. etc) sau la deschiderea unui punct de lucru, in cazul in care spatiul destinat sediului social sau punctului de lucru face parte dintr-un imobil cu mai multe apartamente, respectiv are destinatie locativa initiala, va este necesar acordul asociatiei de locatari (sau, dupa caz, de proprietari), precum si al vecinilor direct afectati.

Documentul trebuie sa contina:

  • semnaturile vecinilor direct afectati
  • semnatura Presedintelui de asociatie
  • avizul Comitetului Executiv al asociatiei
  • stampila asociatiei

De la caz la caz, pot exista cateva particularitati. Spre exemplu, nu este obligatoriu ca vecinii afectati sa fie membri ai asociatiei. Este important ca proprietarii direct afectati (care au perete comun cu spatiul la care ne referim) – cel de sus, cel de jos, cel din stanga si cel din dreapta – sa-si dea acordul privind folosirea spatiului ca sediu social (cu sau fara activitate), sau ca punct de lucru.

Mai poate fi intalnita situatia in care imobile cu mai multe apartamente (poate fi cazul atat al unor blocuri obisnuite, cat si al unor vile cu cateva apartamente) sa nu aiba constituita o asociatie de proprietar/locatari. In acest caz, va este necesara o declaratie a proprietarului spatiului, pe care doriti sa-l folositi in scop comercial cum ca, imobilul respectiv nu face parte din nici o asociatie de proprietari sau de locatari. Acordul vecinilor direct afectati va fi, insa, necesar.

In situatia in care spatiul se afla “la casa”, intr-un imobil in care nu se afla mai multe apartamente, nu va este necesar acordul vecinilor si nici declaratie privind inexistenta asociatie de proprietari/locatari.
